By accessing or using Emerserve.com, its services, or any related programs, you (“the Applicant,” “the Artist,” or “you”) agree to be bound by these Terms & Conditions.

To access Emerserve.com services, you must be at least 18 years old. If under 18, a parent or legal guardian must complete and sign all forms on behalf of the Applicant. The Company reserves the right to verify identification before activating any account or service.

Benjamin Verde Inc provides artist-focused services, including:

Artist Management– $56/hour (minimum 3 hours monthly)

Artist Development – $150/month (6-month minimum commitment)

Artist Lending– $25 application fee per submission, 18% annual interest rate per approved application

Grant Applications – $15 per application

Investor Pitch Meetings – $250 per meeting

All fees are subject to applicable taxes and may change without notice.

* All payments are due in advance unless otherwise agreed in writing.

* Invoices for services are due upon receipt.

* All payments must be electronic(credit card, e-transfer, pre-authorized debit or money order), no cash is accepted by the Company.

* All fees are non-refundable, including application, consulting, and administrative fees.

* Late payments may result in suspension or termination of services.

* All e-transfers must be sent to pay@benjaminVerde.com

* All unpaid balances will be sent to an external collection agency once the balance exceeds 30 days.

* The Applicant is responsible for any applicable collection fees and surcharges.

* The unpaid balance will accrue interest at the rate of 30% per annum.

* All funding is subject to underwriting and risk assessment by the Company.

Approved funds will be *held in trust by Benjamin Verde Inc.** and disbursed in accordance with Company policy.

* Funding approval does not constitute employment or partnership.

Applicants and Artists may not:

* Submit illicit, pornographic, defamatory, or infringing content.

* Misrepresent their identity, age, or eligibility.

* Use the Company’s name or brand to solicit funds, represent third parties, or enter into contracts without written authorization.

Violations may result in immediate account termination, forfeiture of fees, and potential legal action.

By participating in Company programs, the Artist grants the Company a perpetual, worldwide, royalty-free, and license-free right to use their name, image, likeness, performance materials, and related content for marketing, publicity, and promotional purposes.

Participation in Company programs does not guarantee funding, representation, or career advancement. The Artist understands that results vary based on individual effort, market conditions, and other factors outside the Company’s control.

Benjamin Verde Inc. shall not be liable for any damages (direct, indirect, incidental, or consequential) arising out of participation in its programs or use of its website. This includes but is not limited to loss of income, opportunity, or reputation.

The Company may collect and store personal information as required for verification, funding, or communication purposes. All information is handled in accordance with the Company’s Privacy Policy and applicable Canadian data protection laws.

The Company reserves the right to suspend or terminate any Applicant or Artist account without notice if:

* Payments are overdue,

* Terms are violated, or

* Misconduct or misrepresentation occurs.

All outstanding fees and obligations remain payable upon termination.

Any dispute arising under these Terms shall first be resolved through mediation. If unresolved, it shall be governed by the laws of the Province of Ontario, Canada, and subject to the jurisdiction of the courts in Toronto, Ontario.

The Company reserves the right to update these Terms & Conditions at any time without prior notice. Continued use of the website or services constitutes acceptance of the revised Terms.
